1. Acceptance of Terms

By accessing or using the website located at chicoinsulation.com (the "Site"), or by requesting or receiving services from Chico Insulation("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or our services.

2. Description of Services

Chico Insulation provides residential and commercial insulation contracting services in Northern California, including but not limited to spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, vapor barrier installation, air sealing, and related services. All services are subject to availability, scheduling constraints, and site conditions assessed during an on-site estimate.

The Company reserves the right to decline to provide services at its sole discretion, including in cases where site conditions are deemed unsafe, permit requirements cannot be met, or the scope of work falls outside our area of expertise.

3. Estimates and Pricing

Written estimates provided by the Company are valid for 30 days from the date of issuance unless otherwise stated. Estimates are based on information available at the time of the on-site assessment. The final price may change if:

• Site conditions discovered during installation differ materially from those observed during the estimate
• Additional work is requested by the customer after the estimate is accepted
• Material costs change due to supplier pricing adjustments between the estimate date and the installation date

Any changes to the scope or price will be communicated to you before additional work proceeds. Verbal estimates are not binding. Only written, signed agreements constitute a contract for services.

4. Scheduling and Cancellation

Job scheduling is confirmed in writing or by phone with a Company representative. We reserve specific time slots for confirmed jobs. The following cancellation terms apply:

• Cancellations made more than 48 hours before the scheduled start date are accepted without penalty.
• Cancellations made within 48 hours of the scheduled start date may be subject to a cancellation fee of up to 15% of the estimated job value to cover mobilization costs.
• If the Company must reschedule due to weather, permitting delays, or circumstances outside our control, no cancellation fee will apply.

The customer is responsible for ensuring that the work area is accessible and prepared as agreed. If the crew arrives and the site is not ready, a rescheduling fee may apply.

5. Payment Terms

Payment terms are as follows unless otherwise agreed in writing:

• A deposit may be required prior to scheduling. Deposit amounts will be specified in the written estimate.
• The remaining balance is due upon completion of the work, before the crew leaves the job site, unless a payment schedule has been agreed in advance.
• Accepted payment methods include check, cash, and electronic transfer. Credit card acceptance is subject to availability and may include a processing fee.
• Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month on the unpaid balance.

The Company reserves the right to place a mechanics lien on the property for unpaid work in accordance with California law.

6. Warranty Disclaimers

The Company warrants that all work will be performed in a workmanlike manner and in accordance with the written agreement. Manufacturer warranties on materials pass through to the customer where applicable.

The Company does not warrant against damage caused by pre-existing structural deficiencies, moisture intrusion unrelated to the work performed, pest activity, acts of nature, or modifications made to the work by anyone other than the Company after installation.

To the extent permitted by California law, all other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, are disclaimed. The Site and its content are provided "as is" without warranty of any kind.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.

The Company's total liability to you for any claim arising from or related to our services will not exceed the amount you paid for the specific services giving rise to the claim.

8. Customer Responsibilities

You agree to provide accurate information when requesting services. You are responsible for:

• Ensuring the work area is accessible, cleared, and safe for our crew on the scheduled installation date
• Disclosing any known site conditions, hazards, or previous work that may affect the installation
• Vacating the premises for the agreed re-entry period following spray foam installation
• Obtaining any required homeowner association approvals prior to scheduling work

9. Intellectual Property

All content on the Site, including text, images, logos, and page layouts, is owned by or licensed to Chico Insulation and is protected by copyright and other applicable laws. You may not reproduce, distribute, or create derivative works from any Site content without our express written permission.

10. Dispute Resolution

If a dispute arises between you and the Company related to our services or these Terms, we ask that you contact us first and give us a reasonable opportunity to resolve the issue. Most issues can be addressed through direct communication.

If direct resolution is not possible, both parties agree to attempt resolution through non-binding mediation before pursuing litigation. Mediation will be conducted in Butte County, California, by a mutually agreed upon mediator.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of CA, without regard to its conflict of law provisions. Any legal action arising from these Terms or our services will be brought exclusively in the state or federal courts located in Butte County, California.

12. Modifications to These Terms

We reserve the right to update these Terms and Conditions at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
